1. Services

Tee'z Up Texas provides mobile golf simulator rental and event services in Brazoria County and surrounding areas of Texas. All bookings are subject to availability and confirmation by the Company.

2. Age Requirement

You must be 18 years of age or older to book an event with Tee'z Up Texas. By submitting a booking request, you confirm that you are at least 18 years old. Tee'z Up Texas reserves the right to request proof of age and to refuse or cancel any booking made by a person under 18. Minors may participate in events only under the direct supervision of the adult who booked the event, who assumes full responsibility for their safety and conduct.

3. Assumption of Risk

Participation in golf simulator activities involves physical activity. By booking and using our services, you and all participants voluntarily assume all risks associated with the use of the golf simulator equipment, including but not limited to physical injury, property damage, or other harm that may result from participation. You acknowledge that golf involves swinging clubs and that injuries can occur even in a simulated environment.

4. Limitation of Liability & Waiver

To the fullest extent permitted by applicable law, Tee'z Up Texas, its owners, employees, contractors, and agents shall NOT be liable for any injury, illness, death, loss, damage, or expense of any kind — including personal injury or property damage — arising out of or in connection with the use of our equipment or services, whether caused by negligence or otherwise.

By booking our services, you agree to release, waive, discharge, and hold harmless Tee'z Up Texas from any and all claims, demands, or causes of action arising from your participation or the participation of any guest at your event.

5. Client Responsibilities

The client is responsible for ensuring a safe and suitable setup area at the event location, including adequate space (minimum 15ft x 20ft with 10ft ceiling clearance), a level surface, and access to power. The client is responsible for the behavior of all guests using the simulator. Any damage to equipment caused by misuse, negligence, or intentional acts by the client or their guests will be the financial responsibility of the client.

6. Booking & Payment

A booking is not confirmed until you receive written confirmation from Tee'z Up Texas. Pricing is as listed on our website and is subject to change.

Payment is required to secure your booking and must be made via one of the following accepted methods: • Stripe (credit/debit card via secure online payment link) • Cash (collected at time of service)

No other forms of payment are accepted. The person who submits the booking request is solely responsible for full payment of all agreed-upon fees. Failure to remit payment by the agreed-upon date may result in cancellation of the booking and, if necessary, pursuit of the outstanding balance through legal action, including but not limited to collections or civil court proceedings.

We reserve the right to refuse service at our discretion.

7. Cancellation & Refund Policy

We understand that plans change. The following cancellation and refund policy applies to all bookings:

• Cancellations made 7 or more days before the event: Full refund issued. • Cancellations made 3–6 days before the event: 50% refund issued. • Cancellations made less than 48 hours before the event: No refund. The full booking amount is owed and due. • No-shows (client is not present or venue is inaccessible at the scheduled time): No refund. Full payment is still required.

Rescheduling: You may reschedule your event at no charge if notice is given at least 72 hours in advance, subject to availability. Rescheduling requests made within 72 hours of the event are treated as cancellations under the policy above.

Tee'z Up Texas Cancellations: In the event that Tee'z Up Texas must cancel due to equipment failure, weather, or other circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional cost.

8. Weather & Outdoor Events

For outdoor events, Tee'z Up Texas reserves the right to cancel or postpone services due to unsafe weather conditions including but not limited to lightning, heavy rain, or high winds. Client safety and equipment protection are our top priorities.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tee'z Up Texas and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of our services or your violation of these Terms.

10. Governing Law & Legal Action

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Brazoria County, Texas.

Tee'z Up Texas reserves the right to pursue all available legal remedies — including civil litigation and referral to collections — against any client who fails to fulfill their payment obligations under these Terms.

11. Changes to Terms

Tee'z Up Texas reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our services following any changes constitutes your acceptance of the revised terms.
